Are you ready to comply with new Food Service legislation?


Food businesses in the hospitality and retail food service sectors in NSW will be required to have at least one trained food safety supervisor. Some businesses will be exempt (see list below). The legislation will be implemented from 1 April 2011 and enforced from 1 October 2011 when fines of up to $660 will apply. 


ATS is an approved RTO, which means we can deliver food safety training and issue Food Safety Supervisors (FSS) certificates under the NSW Food Authority.Salad

 

Please beware before selecting a FSS Course to enrol in, in NSW, your training is delivered by an approved provider on the NSW Food Authority website. RTO's from other states, not listed, can issue the statements of attainment but cannot issue the NSW FSS certificate.

• A one day face to face training course with ATS in Sydney's CBD, Campbelltown, Miranda & Manly, or
• You can complete the course online

Businesses affected

The food safety supervisor requirement applies to businesses serving food that is:

  • Ready to eat
  • Potentially hazardous, and
  • Not sold and served in its package

Examples of businesses* include: restaurants, cafes, takeaway shops, caterers, bakeries, pubs, clubs, hotels and supermarket hot food sales.

*Note that this is not a comprehensive list. Other businesses that serve food that meets the above criteria, together with accommodation, service or entertainment where there is an inclusive charge which covers the food supplied would also fall under the FSS legislation. For example, B & B’s, motels, hotels, entertainment venues.

Key training requirements

Each appointed food safety supervisor will need to:

  • Complete the two nationally recognised units of competency:
    1. SITXOHS002A - Follow workplace hygiene procedures
    2. SITXFSA001A - Implement food safety procedures Or SIRRFSA001A - Apply retail food safety practices. Please note, whether you are in the Hospitality or Retail industry, you can complete our course & fully comply.


Exempt business

At this stage the food safety supervisor requirement will not apply to businesses licensed by the Authority or:
  • coffee vendors that only heat milk
  • not-for-profit community and charitable causes
  • school canteens (primary & secondary)
  • boarding schools
  • children's service (childcare centres)
  • out of school hours care services
  • correctional centres
  • supermarkets (if heated food is not sold)
  • food business premises that only do one or more of the following articles only:
  1. slice fermented meats or small goods, or both
  2. slice or portion cheese, or both
  3. process raw seafood
  4. slice or portion fruit or vegetables, or both that is ready-to-eat
